MINUTES OF THE PLANNING COMMITTEE MEETING ON 17 APRIL 2023 AT 7.30PM IN THE LIONEL RIGBY ROOM AT THE VILLAGE CENTRE, ROGERS LANE, STOKE POGES, SL2 4LP

The meeting is open to the public and press and the first 15 minutes will be reserved, if required, for public comment. 

One member of public asked about a possible illegal entrance way at Lady Hatten Place.  They were advised to send photo’s to the clerk who would then inform Enforcement.

124/PL/23 Apologies for Absence

APOLOGIES were received from Cllr Knox-Scott.

125/PL/23 Declarations of Interest

Members to declare any personal interest in any item of business as defined in the Code of Conduct 2007.  If that interest is a prejudicial interest as defined in the Code, the member should withdraw from the meeting for that item. 

Cllr Carter declared an interest in application PL/23/0756/FA as a neighbour and consultee and informed the committee that she would leave the room for the whole of the discussion and decision making on that application. Cllr Carter left the room before discussion started on the application at 8.40pm and did not return until invited back after the discussion and decision on comments were made by the remaining committee at 8.55pm.

126/PL/23 Minutes

RESOLVED TO approve the Minutes of the Planning Meeting held on 20 March 2023 which were signed by the Chairman.

127/PL/23 Planning Applications

(i) RESOLVED to approve delegated decisions submitted for Planning Applications for which the response date was prior to this Committee Meeting.   See Appendix 1.

(ii) RESOLVED to consider and formulate a response to new Planning Applications received. See Appendix 2. Plus, amended plans for information only.

District Decisions made since the last Planning Committee Meeting.  See Appendix 3.

129/PL/23 Councillors/Members Update

Cllr Crocker complained about Enforcement and asked if there was anything that could be done to expedite matters.

Cllr Finan informed the committee that Jasmine Lodge on School Lane had erected a new fence higher than what is permitted.  Clerk to report.

Cllr Carter reported that Rotherfield on Gerrards Cross Road had been completely demolished, Clerk to report.

130/PL/23 Correspondence

NOTED permission given to Clerk from Full Council to write for details of Land Sites owned/leased in Stoke Poges. Clerk had been informed that an officer is working on the list.

NOTED clerk written to CIL Payments department, reply states that only one payment has been awarded so far since the scheme was adopted in 2020.  Terms of spending are in the link on the email sent.

131/PL/23 Meeting Equipment

Trialled using a monitor and google earth and one conversation at a time.  Monitor did not work properly but everyone had their own laptops which worked just as well.

No updates this month.

133/PL/23 Exclusion of the Press & Public

Public Bodies (Admission to Meetings) Act 1960 RESOLVED to exclude the press and public from the following business because publicity would prejudice the public interest by reason of the confidential nature of the business.  Part two items: To discuss any possible unlawful buildings or business’s which have not been granted enforcement notices and therefore are not public.

Parish Comments:- Object, The relevance of Oakmead and Stoke Park Estate are completely separate and have no connection so there is no need for a private path to Oakmead.  The materials used are not ecologically sustainable.  This is not in keeping with the original Brown design and we support the letter of objection to Richard Regan the planning officer from the Gardens Trust.

Parish Comments:- Object, policies EP3, H9, H11 (b) & (d), Appendix 8 3.1 all apply.

The proposed development, by virtue of a combination of its size, scale, massing, style and proximity to the sites flank boundaries, would appear over dominant, obtrusive and out of keeping, as well as appearing as a cramped overdevelopment of the site. As such, it would have an adverse impact on the street scene and the character and visual amenities of the area. Therefore the proposal is contrary to policies H9 and EP3 of the South Bucks District Local Plan (adopted March 1999), and policy CP8 of the South Bucks Core Strategy (adopted February 2011), and the NPPF. Furthermore, the proposed development would not reflect the form or height of existing buildings on this designated Formal Suburban Road, to the detriment of its appearance and character and contrary to the content of the South Bucks Townscape Character Study.

Proposed change of use of clubhouse to a cafe with the erection of an ancillary toilet block and formation of an outdoor seating area with a canopy, bin store, delivery enclosure and landscaping

Two storey side extension and part two, part single storey side extension - (Resubmission of planning approval - PL/19/1990/FA

Parish Comments:- Object, policies GB1, GB10, HY11 (a), (b), & (c), & CP9 all apply. We believe that this exceeds the 50% Green Belt Rules.

This proposal, together with previous extensions that have been carried out to the dwelling house would, by virtue of the resultant size and scale of the building when considered in relation to the original building and its potentially intrusive impact upon its setting in the landscape, contribute to the erosion of the Greenbelt which, individually and when considered in the context of accumulation of other similar proposals, would detrimentally affect the aims objectives go the Greenbelt. As such, the proposal is contrary to Policies GB1 and GB10 of the SBDC Local Plan (adopted March 1999)

Remodelling of rear garden, including retaining walls (part retrospective) 

Parish Comments:- Object our previous comments still apply which were:-

Object The proposed rear boundary wall, if permitted, would result in a visually intrusive feature that would appear over dominant to the existing adjoining gardens whose features of which are mostly soft vegetative boundaries rather than formal engineered structures.  This would have an urbanising impact on the locality and would have a detrimental impact on the properties overlooking and adjoining.  As such it is considered that this element of the proposal is contrary to policy EP3 of the SBD local plan.

The garden has already been decimated over the last few months and tons of vegetation has been removed along with many mature trees which have been taken out, allowing this wall will mean that the surrounding gardens will be undermined.  The Townscape Character Study part 3.3 applies.

PLANNING DECISIONS

PL/22/4210VRC Autologic Systems, Brockhurst Park, Rickmans Lane, Stoke Poges, Bucks, SL2 4AF

Variation of condition 8 (approved plans) of pp PL/19/3391/DE (Application for reserved matters following outline pp 17/01996/OUT Redevelopment of site to provide three detached dwellings with detached garages) for access, appearance, landscaping, layout and scale) to allow for changes to landscaping and the addition of fencing, brick walls and gates.

Amendments to proposed boundary treatments.

Parish Comments: - Object, policies EP3 (e) & (f) apply.

This proposal, if permitted would be likely to act as a precursor of further applications for similar types of development within this part of the Greenbelt, which the Planning Authority would find increasingly difficult to resist and which, which, cumulatively, would seriously prejudice the openness of the Greenbelt and the aims and objectives of Greenbelt policy.

The proposed front boundary wall, if permitted, would result in a visually intrusive road-side feature that would appear prominent in the street scene, the predominant existing roadside features of which are mostly soft vegetative boundaries rather than formal engineered structures.  This would have an urbanising impact on the locality and would have a detrimental impact on the character and appearance of the street scene.  As such it is considered that this element of the proposal is contrary to policy EP3 of the SBD local plan.

By way of design, in the context of the sites surroundings, the proposed gates would adversely affect the character and amenities of the street scene and the locality in general and would fail to respond positively to the features of the site itself and the surrounding context.  The proposal would therefore fail to comply with policies EP3 and H9 of the South Bucks District Local Plan (adopted March 1999) as well as CP8 of the South Bucks Core Strategy Development Plan Document and would be contrary to the above provisions of the Local Plan, NPPF and National Design Guide.

Parish Comments: - Object, the building is located withing the curtilage of Tithe Barn which is a grade II listed building.  The Lodge has already been demolished without prior approval! and this proposal is irrelevant because it has already been illegally demolished.  We have reported the illegal demolishment to Enforcement.

Change of use of land to dog exercise area with associated shelter, car parking and fencing.

Parish Comments: - Object, policies GB4, GB5 and TR5 apply.  

We consider this would be urbanisation of the Green Belt by reason of the introduction of fencing, parking and activity facilitated by the proposed use.

We are fortunate enough to have many fields available for dog walking.  We have four doggy day care facilities already in the village.

We would point out that this is a landfill site where, we understand, there are possible contaminants.

No exceptional circumstances have been demonstrated for change of use from Green Belt to commercial.

The proposed fencing would introduce an intense industrial appearance to this designated Green Belt area.  The existing fencing is sympathetic to Green Belt area.

The applicant states there is existing parking for two vehicles but to our knowledge there is no such parking.

If the authority is minded to approve we believe this will act as a precursor to similar applications and an encroachment on 

the Green Belt.
