Installation of 2 polytunnels and administration marquee for a period of three years (part retrospective).
Parish Comments: Object, there are never ending temporary works applications for this site which are applied for retrospectively and there is not enough information given on the requests. Why is there not a sitewide masterplan for this address?
We know this information/guidance of polytunnels in the Green Belt which we believe should be followed:
Polytunnels are generally allowed in the Green Belt for agricultural and horticultural purposes as they are often not considered inappropriate development. However, they still require planning permission if they are large, commercial, or have a more permanent structure, and must be assessed against Green Belt policy, especially concerning their impact on visual amenities and openness.
Key considerations
- Agricultural and horticultural use: Polytunnels for growing crops are generally accepted as a form of agricultural development.
- Impact on Green Belt: Even if agricultural, the polytunnel must still comply with Green Belt policy. It cannot negatively impact the visual amenities or openness of the Green Belt.
- Structure and permanence: Polytunnels with more permanent structures, such as solid bases, can be more contentious and may be treated differently than temporary structures.
- Scale and use: Large commercial polytunnels, or those used for more than simple horticulture, are more likely to require specific planning permission.
- Local restrictions: Special rules may apply in areas like National Parks, Areas of Outstanding Natural Beauty, or where there are listed buildings or ancient woodlands nearby.
We also know this guidance for Marquees in the Green Belt; this guidance should be adhered to: marquees in the Green Belt which would need to demonstrate very special circumstances to be allowed:
Marquees are generally not allowed in the Green Belt without a formal planning application or specific permission because of its protected status. Building in the Green Belt is restricted, and temporary structures are only allowed under strict conditions, such as for pubs and restaurants under specific permitted development rights for temporary use (no more than 28 days for private use), but these don't apply to public Green Belt land.
Key considerations
- Protected status: The Green Belt is a protected area, and any development is restricted to protect openness and prevent urban sprawl.
- Permission: You will almost certainly need approval from the local council to put up a marquee on Green Belt land, even for short-term or private use.
- Public use: Using a marquee for commercial or public-facing activities (like a wedding venue or festival) is considered a change of land use and will likely require planning permission.
- Temporary structures: Even with the general allowance for temporary structures for pubs and restaurants (under 28 days), this rule doesn't typically apply to public land in the Green Belt.
- Special circumstances: There are rare cases where a temporary marquee might be allowed in the Green Belt if it can be argued that it serves "very special circumstances," but this is a high bar to meet.
- Landowner permission: You must get permission from the landowner, even if you are on private property.

The proposed detached double garage, by virtue of its height scale and siting, would appear unduly prominent and detrimental to the character and appearance of the street scene and the locality in general, and would therefore be contrary to Policies EP3 and H13 of the SBDC Local Plan (adopted March 1999).
By virtue of its proposed scale, design and siting within the plot, the proposed detached garage building would appear as a prominent and obtrusive feature within the street scene. Given its overall height and footprint, the building would not be considered to appear very subordinate when viewed in the context of the dwelling on site and would rather appear as a competing feature not compatible with the character and amenities of the site itself, adjoining developments and the locality in general. The proposed development would result in the imposition of an alien feature such as that proposed within the local vernacular would cause further harm to the character and appearance of the street scene. As such, the proposal would be contrary to policies EP3 and H13 of the South Bucks District Local Plan (adopted March 1999, Consolidated September 2007 and February 2011), policy CP8 of the South Bucks Core Strategy (adopted February 2011), the NPPF and the National Design Guide.

Parish Comments: There are concerns around public transport and its lack of infrastructure within the locality. The only public transport is an infrequent bus service.
Even though there is a network of paths and cycle routes, they are not all accessible or usable at this point. The Parish Council have undertaken a survey of all footpaths recently for its Neighbourhood Plan, many of the paths are impassable, gates or styles are also broken, none are suitable for a push chair/ buggy or wheelchair users. As this development progresses and increases our population the Parish Council would like to request a Section 106 to contribute towards a project to address these problems and make them accessible to bicycles and buggies etc. We believe our Neighbourhood Plan sets this out as below:

2.3.8 The Neighbourhood Plan Objectives are as follows:
• Connected Buckinghamshire – provide efficient and reliable transport network
• Growing Buckinghamshire – secure good road, public transport, cycle and walking infrastructure and service provision to meet the needs of residents
• Healthy, Safe and Sustainable Buckinghamshire – promoting sustainable transport choices and access to opportunities
• Empowered Buckinghamshire – allow everyone to access the educational, work and social opportunities they need
2.3.9 The Plan states that public transport and other sustainable transport methods such as walking and cycling should be encouraged as much as possible to ensure settlement areas are well-integrated and connected.

The proposed development, by virtue of a combination of its size, scale, massing, style and proximity to the sites flank boundaries, would appear over dominant, obtrusive and out of keeping, as well as appearing as a cramped overdevelopment of the site. As such, it would have an adverse impact on the street scene and the character and visual amenities of the area. Therefore, the proposal is contrary to policies H9 and EP3 of the South Bucks District Local Plan (adopted March 1999), and policy CP8 of the South Bucks Core Strategy (adopted February 2011), and the NPPF. Furthermore, the proposed development would not reflect the form or height of existing buildings on this designated Formal Suburban Road, to the detriment of its appearance and character and contrary to the content of the South Bucks Townscape Character Study.

We would like to draw your attention to the Stoke Poges Design and Guidance Codes of the Neighbourhood Plan September 2023 page 67, LB01, 1, 2, 3, & 4. Page 70, LB03. This has now been completed via regulation 14.
4. Decision-making
48. Local planning authorities may give weight to relevant policies in emerging plans according to:
(a) the stage of preparation of the emerging plan (the more advanced its preparation, the greater the weight that may be given).
(b) the extent to which there are unresolved objections to relevant policies (the less significant the unresolved objections, the greater the weight that may be given); and
(c) the degree of consistency of the relevant policies in the emerging plan to this Framework (the closer the policies in the emerging plan to the policies in the Framework, the greater the weight that may be given).
The Ecology and Trees checklist states that they are not within 200 meters of a pre-1960 or pre 1914 building or woodland which is not true.
Also, point number 1 on the officer’s refusal for the original application still apply to this application and were:
The proposed development by reason of its poor architectural design, rationale and layout would result in a visually discordant development which would fail to provide a high-quality design that would appear appropriate within the character and scale of the surrounding area. The proposal would therefore constitute a poor form of development which fails to take the opportunity to contribute positively to making places better for people and would be detrimental to the character and appearance of the site and immediate and wider area.
