Parish Comments: Object. The advice from the Local Area Technician was to prune these trees sufficiently so they no longer impacted the highway, not to fell them! We object to the loss of three healthy trees and note that they have recently had TPO’s added to them and are there to enhance the Conservation Area.

Temporary change of use of land to Kitchen Garden (Sui Generis) and erection of greenhouses, timber trellis fencing, landscaping and associated works for a period of three years (retrospective).

Parish Comments: Object, we believe that the trellis would detract from the openness. We notice that all applications for this site happen to be retrospective! There is no evidence to prove the removal of the temporary planning application. In the absence of a Heritage Report it is difficult to see the mitigation versus the harm in the Green Belt and Conservation Area. Once temporary permission has been granted we believe it is increasingly difficult for the Planning Authority to resist permanent permission.

The proposed detached double garage, by virtue of its height scale and siting, would appear unduly prominent and detrimental to the character and appearance of the street scene and the locality in general, and would therefore be contrary to Policies EP3 and H13of the SBDC Local Plan (adopted March 1999).

By virtue of its proposed scale, design and siting within the plot, the proposed detached garage building would appear as a prominent and obtrusive feature within the street scene. Given its overall height and footprint, the building would not be considered to appear very subordinate when viewed in the context of the dwelling on site and would rather appear as a competing feature not compatible with the character and amenities of the site itself, adjoining developments and the locality in general. The proposed development would result in the imposition of an alien feature such as that proposed within the local vernacular would cause further harm to the character and appearance of the street scene. As such, the proposal would be contrary to policies EP3 and H13 of the South Bucks District Local Plan (adopted March 1999, Consolidated September 2007 and February 2011), policy CP8 of the South Bucks Core Strategy (adopted February 2011), the NPPF and the National Design Guide.

Parish Comments: We would like to suggest a S106 agreement is entered into in connection with the removal of trees as an ecological mitigation or biodiversity new gain measure. Historically we have noted that Landscaping Schemes have been ignored with the Local Planning Authority unempowered to enforce one.

Application under Section 106 of the Town & Country Planning Act 1990 (as amended) to remove Clause 6 and Clause 7 from the existing Unilateral Undertaking with regards to application Ref: PL/19/1634/FA dated 8 May 2019. application Ref: PL/19/3599/FA dated 17 October 2019 and the 2 subsequent appeals APP/N0410/W/20/3245197 and APP/N0410/W/20/3248594.

Planning Comments: Object to any conditions being removed due to the sensitivity of the location. The conditions were imposed for justifiable reasons.

Proposed Country Park to incorporate general footpaths and associated landscaping, a new children's play area, change of use of existing clubhouse building to be utilised as a cafe with an associated outdoor toilet block and an area for informal overflow car parking.

PL/25/4282/PIP Application for Permission in Principle Spring Cottage, Stoke Wood, Stoke Poges, Buckinghamshire, SL2 4AU

Permission in principle for construction of a minimum of two and a maximum of two detached dwellings with associated landscaping, following the demolition of existing dwelling and garage.

Notwithstanding, this does not alter my findings on whether the site is in a village. Altogether, despite comprising limited infilling, the proposal would not be in a village and is therefore inappropriate development in the Green Belt under Paragraph 149 (e) of the Framework.

Openness

The site’s location is sparsely developed and residential in character, with large dwellings on correspondingly large plots of land set within a countryside location. Consequently, the pattern of development and spatial context is one of openness. the area is generally well landscaped, and this provides significant screening of buildings where views are limited from the highway and surrounds. Consequently, the visual context is also one of openness.

The proposal seeks to introduce two detached dwellings at the site, following the demolition of the existing dwelling and outbuilding. Clearly, even a limited net increase in dwellings at the site would intensify the built form and erode the openness of the Green Belt’s spatial context.

Whilst I acknowledge that one of the dwellings would take a position similar to the existing outbuilding, a dwelling is not comparable in scale to an outbuilding and would intensify the built form.

Furthermore, an additional dwelling would bring with it the associated domestic paraphernalia including vehicles, fencing and boundary treatments, which among other things would contribute to the intensification of the site.

A shortfall in five-year housing land supply would engage Paragraph 11 (d) of the Framework. However, my findings on the Green Belt and lack of very special circumstances mean that the application of policies in the Framework provides a clear reason for refusing the development proposed. Consequently, the presumption in favour of sustainable development is not engaged.

Parish Comments: Object, GB policies c & k. The form says no trees or hedgerows, but Google Earth clearly shows several mature trees on the entrance to the property. There are also hedgerows and a mature tree in the rear garden.

Parish Comments: - Our previous comments apply which were: -

Object policies TR7 and TR5 both apply

We have concerns regarding the number of parking spaces being provided for this development. Duffield Lane in particular is already suffering due to the loss of parking in Rogers Lane. This, and the school time parking issues, is already putting extreme pressure on the surrounding area. Duffield Lane has a blind bend which has become hazardous with cars parking on one side of the road. We do not believe there are enough spaces for the number of dwellings proposed for this site and visitors to the development. (61 dwellings and 117 car parking spaces).

Stoke Poges is a location totally lacking in any form of public transport. Cars are heavily relied on.

Also: -

The Parish Council agree that opening up Grays Walk is likely to attract more traffic as it may become an attractive place to visit/ walk. With the pressures of parking in this vicinity we would support the walk not being opened to the general public. The Parish Council also question who will be responsible for ongoing maintenance!

The Parish Council feel that in this instance extra parking on the proposed site is likely to be far more beneficial to the locality than the loss of GB. We would support this option looking at alternatives other than tarmac.

PL/25/2108/FA Carrillon, Hollybush Hill, Stoke Poges, Buckinghamshire, SL2 4PX

Erection of dwelling, creation of new vehicular access and hard and soft landscaping works.

Parish Comments: Object, our previous comments from a similar application last year which the planning authority refused still apply and were:

We agree that we need smaller stock housing however if minded to approve then we believe that all permitted development rights should be removed to prevent further development. We would draw the officer’s attention to this spot which floods for most of the winter, and Carrillon itself uses sandbags for most of the winter. A Traffic Management Plan for an already congested area for parking and from parking for the pub is required. Yellow lines have already been placed in Broom Hill where the entrance to this property is proposed.

The proposal fails to demonstrate that adequate ground investigations have been carried out in order to determine that the proposed sustainable drainage strategy is feasible for the onsite ground conditions, and that the proposed development would be resilient and resistant to the risk of flooding within the site. In the absence of sufficient information in this regard the proposal fails to demonstrate that Core Policy 13 of the South Bucks Core Strategy (adopted February 2011) is satisfied, as well as the requirements of the National Planning Policy Framework.

Reasons for refusal:

1.The proposed development, by virtue of its layout, design, height, width, depth and scale, would appear as a dominant and intrusive feature within the existing street scene of both Broom Hill and Hollybush Hill, whilst the proposed relationship with Carillon would make the resultant relationship appear cramped. These factors would be to the detriment of the character and appearance of the area, including its spaciousness. Accordingly, the proposal would conflict with Policies EP3 and H9 of the Local Plan, Policy CP8 of the Core Strategy, Paragraph 6.1.7 of the Council's Residential Design Guide, Section 12 of the NPPF and Section C1 of the National Design Guide, which collectively and amongst other matters, state that development will only be permitted where its scale, layout and siting are compatible with the character of the site and locality, and poor designs will not be permitted.

2. Inadequate ecological information has been submitted with the application, and it has not been possible to fully assess the impact of the proposal on biodiversity including the impact of the proposed development on protected species. The application has therefore failed to demonstrate how wildlife will not be harmed, as well as failing to demonstrate how net gain for biodiversity will be obtained and is therefore contrary to Core Policy CP9 of the South Bucks Core Strategy (adopted February 2011) and the guidance set out in the NPPF.

3. The occupants of the proposal would add to the recreational disturbance of the Burnham Beeches Special Area of Conservation as the proposal would not contribute satisfactorily to mitigate its impacts in this respect. In the absence of a planning obligation to secure suitable strategic access management and monitoring, to the satisfaction of the Local Planning Authority, the proposal is contrary to Core Policy 9 of the South Bucks Core Strategy (adopted February 2011), Burnham Beeches Special Area of Conservation Strategic Access Management and Monitoring Strategy SPD, and Section 15 of the NPPF.
