MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 21 OCTOBER 2024 AT 7.30PM IN THE LIONEL RIGBY ROOM AT THE VILLAGE CENTRE, ROGERS LANE, STOKE POGES, SL2 4LP.

UPDATED the committee on an agreement made by Full Council to allow the planning committee to engage with Oneil Homer if required for further help on complicated applications as they see fit. An amount has been set aside in the accounts to cover the charges, and the planning committee can decide when to use it without going back to Full Council. It was agreed by all to enlist help with Rotherfield.

Removal of condition 6 (permitted development rights) of planning permission 11/01922/FUL (Redevelopment of site to provide detached dwelling house, incorporating detached garage, associated hardstanding and landscaping. Widening of vehicular access and erection of entrance gates with front boundary wall.)

Parish Comments: - We object the removal of condition 6 relating to the development rights of planning permission 11/01922/FUL because under this permission the development achieved a 50% increase. Footprints is located in a Green Belt area. This condition was applied for good reason and the removal potentially encourages additional applications causing further erosion to the Green Belt.

Single storey rear extension, first floor side extension, internal alterations including additional loft accommodation with rooflights at front and rear roof slopes.

Parish Comments: - Object. The proposed development, by virtue of a combination of its size, scale, massing, style and proximity to the sites flank boundaries, would appear over dominant, obtrusive and out of keeping, as well as appearing as a cramped overdevelopment of the site. As such, it would have an adverse impact on the street scene and the character and visual amenities of the area. Therefore, the proposal is contrary to Policies H9 and EP3 of the South Bucks District Local Plan (adopted March 1999) and Policy CP8 of the South Bucks Core Strategy (adopted February 2011), and the NPPF. Furthermore, the proposed development would not reflect the form or height of existing buildings on this designated Formal Suburban Road, to the detriment of its appearance and character and contrary to the content of the South Bucks Townscape Character Study.

The Council has received an application for the development described above. This is not a planning application, but an application that seeks to demonstrate that the use or the building works, as described above, are "lawful". The applicant must show that the ‘use’ that is the subject of the application has been continuous for more than 10 years or that the ‘building works’ the subject of the application have been substantially complete for more than 4 years, prior to the date of the application. If you have any personal knowledge of how long the use has been carried on and whether the character of the use has changed at all, or, in the case of building works, when those works were completed, the Council would like to hear from you. As this is not a planning application, I must emphasise that the Council is not considering the planning merits of the case. The Council therefore cannot take into account in determining this type of application, whether the use or the building work the subject of the application is, or is not, acceptable, it is purely a legal judgement based on the evidence.

Erection of a 3-bed detached house adjacent to existing house. Construction of a new vehicular access.

Parish Comments: We agree that we need smaller stock housing however if minded to approve then we believe that all permitted development rights should be removed to prevent further development. We would draw the officer’s attention to this spot which floods for most of the winter, and Carrillon itself uses sandbags for most of the winter. A Traffic Management Plan for an already congested are for parking and from parking for the pub is required. Yellow lines have already been placed in Broom Hill where the entrance to this property is proposed.

The proposal fails to demonstrate that adequate ground investigations have been carried out in order to determine that the proposed sustainable drainage strategy is feasible for the onsite ground conditions, and that the proposed development would be resilient and resistant to the risk of flooding within the site. In the absence of sufficient information in this regard the proposal fails to demonstrate that Core Policy 13 of the South Bucks Core Strategy (adopted February 2011) is satisfied, as well as the requirements of the National Planning Policy Framework.

Single storey rear extensions and first floor side extension.

Parish Comments: Object Policy GB1.

This is clearly over the 50% Green Belt Rules. No special circumstances have been demonstrated.

The proposed extensions would result in the creation of a large, bulky unattractive addition. The extended dwelling would be lacking in pleasing proportions and would fail to respect the traditional character of the existing building. In terms of design and scale, the proposed extensions and alterations cannot be considered to accord with the principles set out in policies EP3 and H11 of the South Bucks District Local Plan, and the standard of design would not comply with advice in Appendix 8 of the Plan. The development would therefore not be in accordance with guidance set out in the NPPF (2019).

This proposal, together with previous extensions that have been carried out to the dwelling house would, by virtue of the resultant size and scale of the building when considered in relation to the original building and its potentially intrusive impact upon its setting in the landscape, contribute to the erosion of the Greenbelt which, individually and when considered in the context of accumulation of other similar proposals, would detrimentally affect the aims objectives go the Greenbelt. As such, the proposal is contrary to Policies GB1 and GB10 of the SBDC Local Plan (adopted March 1999)

This proposal, if permitted would be likely to act as a precursor of further applications for similar types of development within this part of the Greenbelt, which the Planning Authority would find increasingly difficult to resist and which, which, cumulatively, would seriously prejudice the openness of the Greenbelt and the aims and objectives of Greenbelt policy.

Part retrospective extension of residential garden and accompanying soft landscaping; erection of 1.8m high timber fence; alterations to existing boundary treatment to provide timber gate with brick posts; formation of hardstanding to form 'in and out' driveway.

Parish Comments: - Object. With reference to condition 13 of the original planning permission 14/00549/FUL the fence should be 1m post and rail only.

Policy GB1 (i) and GB13 apply. We believe this will detract from the openness of the Green Belt so would be harmful.

This proposal, if permitted would be likely to act as a precursor of further applications for similar types of development within this part of the Greenbelt, which the Planning Authority would find increasingly difficult to resist and which, which, cumulatively, would seriously prejudice the openness of the Greenbelt and the aims and objectives of Greenbelt policy.

The appearance of the brick piers and high fences have an urbanising appearance, and the hardstanding is not in keeping.

We would like to draw your attention to the Stoke Poges Design and Guidance Codes of the Neighbourhood Plan September 2023 page 72 Boundary Treatments. This has now been completed via regulation 14. Which can be found on our website.

4. Decision-making

48. Local planning authorities may give weight to relevant policies in emerging plans according to:

(a) the stage of preparation of the emerging plan (the more advanced its preparation, the greater the weight that may be given).

(b) the extent to which there are unresolved objections to relevant policies (the less significant the unresolved objections, the greater the weight that may be given); and

(c) the degree of consistency of the relevant policies in the emerging plan to this Framework (the closer the policies in the emerging plan to the policies in the Framework, the greater the weight that may be given).

Parish Comments: No Comments, however, we would like to point out that there is no evidence of the Ecology report which was requested at the previous application.

Part retrospective, part full application for pergola, metal railing with gate, fish pond, decking, bridge, concrete base and associated plant and storage facilities.

Parish Comments: Object. Again, another retrospective application. As this is in the Green Belt, we do not believe that this is ancillary to the main building and the extra facilities on site lead this to be for further commercial use, cumulatively it is all encroaching on to the Green Belt. We would like to draw your attention to the Stoke Poges Design and Guidance Codes of the Neighbourhood Plan September 2023 section Listed Buildings pages 14 and 18. This has now been completed via regulation 14. Which can be found on our website.

We totally agree with the archaeology report. Page 18 Purpose 3 to assist in safeguarding the countryside from encroachment; Purpose 4 to preserve the setting and special character of historic towns.
